Section 01: Introduction
RentCalculators is dedicated to provide graphing calculator rentals to students, school staff, faculty and academic institutions in the United States. By visiting this website and accessing the free or paid information, materials, resources, services, products, and tools we provide for you, either directly or indirectly, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy, and you claim to understand this agreement in its absolute entirety and agree to contact us to clarify any misunderstandings you may have as soon as it is humanly possible and before you use or rent any of our inventory or use any of our resources. Furthermore, no party has been induced to enter into this agreement by, nor is any party relying on, any representation or warranty outside those expressly set forth in this agreement. By completing the shopping cart checkout process you confirm most definitely that you have read, fully understood, and accepted this agreement, which serves as a legal binding contract between you and RentCalculators. You also certify that any information you provide is true and correct and you declare to be at least 18 years of age and to be an authorized user of the credit/debit card used. We take credit card fraud very seriously.

Section 02: Our goal
Our goal is to improve the level of education in the United States by making education more accessible, affordable, and exciting. Since quantities of graphing calculators are limited we must restrict calculator rentals to only one calculator per individual / household. The submission of multiple orders either simultaneously or in intervals, with identical properties such as personal information, billing information, or a combination of both is automatically rejected.

Section 03: Online orders
To submit your order online simply, navigate to our homepage, click on the button of the calculator that interests you, and complete the three-step checkout process. The website accepts orders 24/7/365.

Section 04: Phone orders
If your order was placed over the phone, your package will be shipped with a copy of this “Terms of Service Agreement” attached to the exterior of the package and a note asking you to read the agreement before opening the package. You must first read this “Terms of Service Agreement” and then open the package. Opening the package states that you have read and fully agreed to this “Terms of Service Agreement.” If you do not agree to any portion of the “Terms of Service Agreement,” do not open the package. Simply, ship it back. If you place/d your order on-line this process does not apply to you. Note that the option of placing an order over the phone is only available when our call volume is low. If our call volume is high you will need to place your order online.

Section 05: Primary-cards
A Primary-card is the credit/debit card used to pay your fees. RentCalculators is not responsible for overdraft fees, bounced check charges, or any charges your bank account or credit card account may experience as a result of an amount charged by RentCalculators to cover the total amount of your order prior to shipping or to cover a subsequent outstanding balance.

Section 06: Backup-cards
A Backup-card is a 2nd credit/debit card provided for backup purposes only, useful to maintain your payment history in good standing and avoid IFF (Insufficient funds fees). If provided, this Backup-card is saved in your file and used in the future only IF the first card you provided (your Primary-card) fails or declines during a future monthly charge. If during checkout, you do not wish to provide a Backup-card, you may provide a 100% refundable Security-deposit instead. Backup-cards must maintain at least $20 in available funds at all times to be considered active or current. While your account remains open, for your convenience, if your Backup-card fails to maintain at least $20 in available funds it will be automatically replaced by a 100% refundable Security-deposit. If you would like to avoid having your Backup-card replaced by a 100% refundable Security-deposit, please maintain at least $20 in available funds at all times in it. RentCalculators is not responsible for overdraft fees, bounced check charges, or any charges your bank account or credit card account may experience as a result of an amount charged by RentCalculators to cover the total amount of your order prior to shipping or to cover a subsequent outstanding balance. All open accounts must maintain an active or current Backup-card OR a 100% refundable Security-deposit at all times. You may read about 100% refundable Security-deposits in the following section.

Section 07: 100% Refundable Security-deposits
You may choose to provide a 100% Refundable Security-deposit instead of a Backup-card. All Security-deposits are temporary, are 100% refundable and are credited back when the calculator is returned and your account is closed. For a full Security-deposit refund, calculator/s must be returned in the same condition it/they was/were sent out, normal wear is expected. The following Security-deposits apply to each calculator: TI-83 plus $35, TI-84 Plus $45, TI-86 $50, TI-89 $55. School orders of more than one calculator are subject to different rates as described in the rental order addendum.

Section 08: Billing cycles
By completing the checkout process and submitting your order you agree to use RentCalculators’ free automated-payment service and authorize RentCalculators to automatically (without further notice) charge applicable fees to your credit/debit card/s until your account is closed. All billing cycles and monthly fees are accrued on the 1st of every month. Rental fees accrue on a calendar monthly basis. Monthly fees are not prorated. Accounts remain "Open" from the time the order is "Submitted" to the time the account is "Closed." Example: Account Opened on 04/17/2010 & Closed on 06/09/2010 (this account is charged the same flat monthly fee for April, May, and June). For this reason, we recommend that you place your order at the beginning of the month but that decision is entirely up to you because quantities of graphing calculator rentals are limited and future availability of these items is not guaranteed. Once you place your order, monthly charges are automatic. The day of the month that your card gets charged during subsequent months is the same day of the month that you placed your order on. Example: If you placed your order on the 11th of the month your card will be charged every 11th of the month until your account is closed. It is crucial that your Primary-card has available funds during this time. A $6.00 IFF (insufficient funds fee) will apply in addition to the monthly charge every month sufficient funds are NOT available at the time your credit/debit card gets charged. You may prevent insufficient funds fees by making sure that your Primary-card always has sufficient funds available to cover the monthly fee and updating the expiration date or replacing your primary card with another one when the original expires. IF YOUR ACCOUNT REMAINS OUTSTANDING WITH A PAST DUE BALANCE FOR MORE THAN 3 CONSECUTIVE BILLING CYCLES, YOUR ACCOUNT WILL BE REPORTED TO COLLECTIONS. You are responsible for your account until it is CLOSED.

Section 09: By submitting your order
By completing the checkout process and submitting your order you authorize RentCalculators to charge your card for the total amount of your order. RentCalculators is not responsible for overdraft fees, bounced check charges, or any charges your bank account or credit card account may experience as a result of an amount charged by RentCalculators to cover the total amount of your order prior to shipping or to cover a subsequent outstanding balance. By submitting your order you also acknowledge that RentCalculators will not contact you to remind you of the automated monthly charges that will be applied to your card to pay for your monthly fee or your outstanding balance. RentCalculators also reserves the right to refuse service to anyone at our discretion. All transactions as well as shipping charges are final.

Section 11: If there is one source of payment (a Primary-card) and a 100% Refundable Security-deposit
If there is one source of payment (a Primary-card) and a 100% Refundable Security-deposit, and the source of payment “declines” or becomes “expired” within 60 days leaving no other source of payment, the difference between the Security-deposit and the value of the calculator will be charged to the card on file and the unused difference will be credited back when the account is closed. The value of the calculators are TI-83 plus $99, TI-84 Plus $129, TI-86 $129, TI-89 Titanium $149. If necessary, please update your billing information. Section 12: Updating your account and/or billing information
It is your responsibility to contact us to update your account and/or billing information at least 60 days prior to their expiration date. For security reasons and for your protection, we do NOT accept credit card information via e-mail. If necessary, please update your billing information. Section 13: How to contact us
For PHONE live support, please call our toll-free number at 1-800-501-1235 Ext.0 Monday-Friday 9:00am-5:00pm (pacific time). This toll-free number also gives you access to our 24/7/365 toll-free pre-recorded information messages with answers to the most basic and most frequently asked questions. For ONLINE support, please log-in to your account with your email address (if you have already submitted your order) OR email us at support@rentcalculators.org if you have NOT submitted an order or have a general question. Communication through your online account and email is our preferred method. All inquiries are individually reviewed and our response time varies depending on various times of the year when we experience high or low costumer service inquiries volume. If you happen to experience longer than usual hold-times and/or our staff is taking longer to reply to your inquiry, we thank you in advance for your understanding and patience, we know that your inquiry is important and we will get to it in the order in which it was received.

Section 14: Three ways to close an account
There are 3 ways to close an account: Option (a) To return the calculator back to us. Calculators must be returned in the same condition they were received. Normal wear is expected. Option (b) If the calculator is lost, damaged, broken, or it got stolen, you may replace it with a calculator of the exact same model in the same condition or better. Refer to Section 17 for details. Option (c) If the calculator is lost, damaged, broken, or it got stolen, you may pay for the value of the calculator. Previously paid rental fees do not apply. There are a couple of reasons why previously paid rental fees do not apply towards the value of a lost, damaged, broken, or stolen calculator, the most important being that rental fees are used to cover operating expenses from previous months. At the time the calculator is reported lost, damaged, broken, or stolen these funds are no longer available to be used to replace the unit (because they are not intended for that purpose in the first place) and if we simply waived the value of the calculator the inventory would eventually disappear hence, the need for this policy. Refer to Section 17 for details.

Section 15: When to ship the calculator to avoid the next monthly fee
You decide when to ship the calculator back. There aren’t any penalties for keeping it longer or sending it back sooner than anticipated. The cutoff day for the calculator to be shipped on any given month to avoid the next monthly fee is the last day of the current month. In other words, you have until the end of the month to ship your calculator back (so it’s postmarked with that date by the post office) and not get charged the next month. All calculators are rented on a month-to-month basis, with NO long-term contracts, and a convenient automatic pay-as-you-go plan. This gives you the freedom to use it for as little or as long as needed without worrying about renewing your plan or anything of that sort.

Section 16: How to ship the calculator back and Where to ship it to (the returns address)
When you decide it is time to return the calculator there is NO need to send any personal or additional information with it, the calculator has a barcode, which is associated to your account and contains all of the information we need to identify it and close your account. Simply, follow these 4 steps: Step (1) Insert the calculator in to a strong bubble-wrap envelope (not included). Step (2) Write our returns address on the package or affix a label to it. Be sure that the label reads clearly and correct. The returns address is: Returns Dept. PO Box 1774 Norwalk, CA 90651-1774. Step (3) Confirm that your package has been sealed properly and if necessary use more tape to seal it well. Step (4) Confirm that your shipping carrier delivers to PO Boxes. Section 17: What if your calculator rental is damaged, lost, or stolen
What if the calculator is damaged, lost, stolen, or our internal seal is broken (which means it was taken apart), shows signs of abuse, you decided to make it part of an amazing science experiment which attempted to detect its melting point, or you shipped it but we never got it and you have absolutely no proof of shipment such as a tracking number or a receipt from the post office. Well, the answer is “yes” and “no.” Yes, you have to replace it or pay for it. And no, previously paid fees do not apply towards the value of the calculator. The value of the calculators are: TI-83 plus $99, TI-84 Plus $129, TI-86 $129, TI-89 Titanium $149. If you choose to replace our calculator by sending a different one, you must (1) Contact us prior to sending the replacement calculator so that we can document your account accordingly and (2) When you ship the replacement calculator, include a piece of paper with your FULL NAME, ACCOUNT NUMBER, and DESCRIPTION of what happened to our calculator. It is extremely important that you (1) contact us and (2) that you include the note with that information otherwise we won’t be able to associate the replacement calculator to your account to stop recurrent charges and close your account accordingly.

Section 18: Legal disclosures
You expressly understand and agree that any claim against us shall be limited to the amount of money you have paid in the last 45 days. RentCalculators, and any of the following parties (if applicable) its parent company, its affiliates, and its owners, shareholders, directors, officers, managers, employees, donors, agents, contractors, partners, representatives and licensors will not under any circumstances be liable to you or any other party for any special, direct, indirect, incidental, consequential, reliance, punitive, or exemplary loss, expenses, or damages which may be directly or indirectly incurred by you or anyone related to you as a result of using our resources, services, or products, or as a result of any changes, data loss or corruption, cancellation, loss of access, negligence on our part to act upon any sign, or downtime to the full extent that applicable limitation of liability laws apply, applicable even when we have been advised or had reason to know of the possibility of such damages. In no event shall our total liability to you for any and all damages, losses, and causes of action, whether in contract, tort (included but not limited to negligence) exceed the amount you have paid in the last 45 days. If applicable law does not allow the limitation or exclusion of liability or consequential or incidental damages and you are unhappy with our resources, services, or products your sole and exclusive remedy shall be to discontinue the use of our resources, services, or products including the website, return any and all of our equipment, and terminate this agreement in accordance with the terms hereof. You agree to use this website and our resources, services, or products at your own risk and to indemnify, defend, and hold entirely harmless RentCalculators, and any of the following parties (if applicable) its parent company, its affiliates, and its owners, shareholders, directors, officers, managers, employees, donors, agents, contractors, partners, representatives and licensors, from and against any and all liability such as but not limited to losses, expenses, damages and costs, including but not limited to interest, penalties, attorney fees, accounting fees and expert witness, known or unknown, contingent or otherwise, directly or indirectly arising from or related to any violation of this agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us. By using our website, you understand and agree that all resources, services, or products we provide are "AS IS" and "AS AVAILABLE". We have done our best to ensure the accuracy of the information provided in this website as well as the good quality of our service but make absolutely NO representations, warranties, or guarantees about its accuracy, relevance or validity of any kind either express/ed, implied, or statutory. We do not represent or warrant to you that the use of our resources, services, or products will meet your individual needs or requirements.
